Welcome to Fayloris. In these Terms, "we", "us" and "our" mean Fayloris. We run this store and website, including all related information, content, features, tools, products and services, to give you a curated shopping experience. Together these are referred to as the "Services".

Fayloris is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies they refer to (the "Terms"), set out your rights and responsibilities when you use the Services. Please read them carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with them, please do not access or use the Services.

1. Access and account

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence. You also confirm that you allow any minor dependants to use the Services on devices you own, buy or manage.

To use the Services, including browsing our online stores or buying our products or services, you may need to provide information such as your email address and your billing, payment and shipping details. You confirm that this information is correct, current and complete, and that you have every right needed to provide it.

You alone are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

2. Our products

We do our best to show our products and services accurately. However, colours and product appearance may look different on your screen depending on the device you use and its settings and configuration.

We do not warrant that the appearance or quality of any product or service you buy will meet your expectations or match how it is shown in our online stores.

We may change product descriptions at any time without notice, at our sole discretion. We may also discontinue any product at any time and limit the quantities we offer to any person, geographic region or jurisdiction on a case-by-case basis.

3. Orders

Placing an order is an offer to buy. Fayloris may accept or decline any order for any reason at its discretion. Your order is only accepted once Fayloris confirms it, and we must receive and process your payment before we accept it.

Please check your order carefully before you submit it, as we may not be able to cancel it once it has been accepted.

If we decline, change or cancel your order, we will try to let you know using the email address, billing address or phone number you gave when placing it.

Returns and exchanges are handled solely under our Refund Policy.

You confirm that your purchases are for your own personal or household use, not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions may change without notice. You will be charged the price in effect when you place your order, as shown in your order confirmation email. Unless expressly stated otherwise, listed prices do not include taxes, shipping, handling, customs or import charges.

Prices in our online stores may differ from those in physical stores or in online or other stores run by third parties. From time to time we may run promotions that affect pricing and that have their own terms and conditions. If a promotion's terms conflict with these Terms, the promotion's terms apply.

You agree to provide current, complete and accurate purchase, payment and account information for every purchase. Please keep your account and other details up to date, including your email address, card numbers and expiry dates, so we can complete your transactions and contact you when needed.

When you provide credit card details, you confirm that:

  • The information is true, correct and complete.
  • You are authorised to use the card for the purchase.
  • Your card provider will honour the charges.
  • You will pay the charges at the listed prices, including shipping, handling and any applicable taxes.

5. Shipping and delivery

All delivery times are estimates and are not guaranteed. We are not liable for shipping or delivery delays, including delays caused by carriers, customs processing or events outside our control.

Title to the products and the risk of loss pass to you once we hand them over to the carrier.

6. Intellectual property

The Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by Fayloris, its affiliates or licensors. They are protected by US and foreign patent, copyright and other intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material on the Services without our prior written consent.

Except where expressly stated, nothing in these Terms grants you a licence or any other rights under any patent, trademark, copyright or other intellectual property of Fayloris, Shopify or any third party. Unauthorised use of the Services may breach federal and state intellectual property laws. Fayloris reserves all rights not expressly granted.

The Fayloris name, logos, product and service names, designs and slogans are trademarks of Fayloris or its affiliates or licensors. You must not use them without Fayloris's prior written permission.

Shopify's name, logos, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services belong to their respective owners.

7. Optional tools

As part of the Services, you may be given access to customer tools provided by third parties. We do not monitor these tools and have no control over or input into them.

You accept that we provide access to them "as is" and "as available", without any warranties, representations, conditions or endorsement of any kind. We have no liability arising from or relating to your use of optional third-party tools.

You use these tools entirely at your own risk and discretion. Make sure you are familiar with and accept the terms on which the relevant third-party provider offers them.

Any new features we add to the Services in the future, including new tools and resources, will also form part of the Services and be subject to these Terms.

8. Third-party links

The Services may contain materials and links to websites provided or run by third parties, including embedded third-party functionality. We are not responsible for reviewing or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to visit them, you do so at your own risk.

We are not liable for any harm or damage related to your use of third-party websites, or to your purchase or use of products, services, resources or content on them.

Please review the third party's policies and practices carefully before entering into any transaction. Direct any complaints, claims, concerns or questions about third-party products and services to the third party.

9. Relationship with Shopify

Fayloris is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Fayloris. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Fayloris, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Fayloris.

10. Privacy policy

All personal information we collect through the Services is subject to our Privacy Policy, available here. Some personal information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm that you have read these policies.

Because Shopify hosts the Services, it collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit through the Services is sent to and shared with Shopify and with third parties that may be located outside your country of residence, in order to provide services to you.

11. Feedback

If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, proposals, plans or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium and for any purpose, including commercial use.

For example, we may use this licence to operate, provide, evaluate, enhance, improve and promote the Services, and to perform our obligations and exercise our rights under these Terms.

You confirm that:

  • You own the Feedback or have all the rights needed to share it.
  • You have disclosed any compensation or incentives you received in connection with it.
  • Your Feedback complies with these Terms.

We have no obligation to keep your Feedback confidential, pay you for it or respond to it.

We may, but are not required to, monitor, edit or remove Feedback that we decide, at our sole discretion, is unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.

Your Feedback must not infringe any third party's rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. It must not contain libellous, unlawful, abusive or obscene material, or any virus or other malware that could affect the operation of the Services or any related website.

You must not use a false email address, pretend to be someone else or otherwise mislead us or third parties about where Feedback comes from. You alone are responsible for your Feedback and its accuracy. We take no responsibility and accept no liability for Feedback posted by you or any third party.

12. Errors, inaccuracies and omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability.

We may correct any such errors, inaccuracies or omissions, change or update information, or cancel orders if information is inaccurate, at any time and without prior notice, including after you have submitted your order.

You also agree not to:

  • Upload or transmit viruses or any other malicious code that will or may affect the functionality or operation of the Services.
  • Reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services.
  • Collect or track other people's personal information.
  • Spam, phish, pharm or pretext the Services.
  • Use any robot, spider, scraping, data gathering or extraction tool, automated device or process, AI tool (such as agentic AI), or any automated or manual means to access the Services.
  • Interfere with, bypass or circumvent our security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services.

14. Agents

  • Not conceal or disguise that access, use or interactions come from an Agent, for example by mimicking human behaviour or interaction patterns, or by completing or getting around CAPTCHAs or other measures designed to tell computers and humans apart.
  • Answer truthfully any question or prompt that asks whether interactions come from a human or a computer.
  • Not circumvent or avoid any measure designed to block, limit, modify or control whether and how Agents access, use or interact with the Services.

15. Termination

We may end this agreement, or your access to all or part of the Services, at our sole discretion, at any time and without notice. You will remain liable for all amounts owed up to and including the date of termination.

The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

16. Disclaimer of warranties

Information on or available through the Services is provided for general information purposes only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is strictly at your own risk.

We disclaim all liability and responsibility arising from reliance on this information by you, any other visitor to the Services or anyone who may be told about its contents.

Except as expressly stated by Fayloris, the Services and all products offered through them are provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, whether express or implied. This includes all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

We do not guarantee, represent or warrant that your use of the Services will be uninterrupted, timely, secure or error-free. Some jurisdictions limit or do not allow the exclusion of implied or other warranties, so the above disclaimer may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, in no event will Fayloris, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of Shopify and its affiliates, be liable for any injury, loss or claim, or for any direct, indirect, incidental, punitive, special or consequential damages of any kind.

This includes lost profits, lost revenue, lost savings, loss of data, replacement costs and any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or of any products obtained through them.

This limitation also covers any other claim related in any way to your use of the Services or any product, including errors or omissions in any content, and any loss or damage of any kind resulting from the use of the Services or of any content or product posted, transmitted or otherwise made available through them, even if advised of the possibility of such damages.

18. Indemnification

You agree to indemnify, defend and hold harmless Fayloris, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims payable to any third party, including reasonable attorneys' fees, arising from:

  • Your breach of these Terms or any documents they incorporate by reference.
  • Your violation of any law or the rights of a third party.
  • Your access to and use of the Services.

We will notify you of any claim covered by this indemnity. A delay in notifying you will not release you from your obligations unless it materially prejudices you.

We may control the defence and settlement of such a claim at your expense, including the choice of legal counsel. We will not settle any claim that requires non-monetary obligations from you without your consent, which you must not unreasonably withhold.

You will cooperate in the defence of any such claim, including by providing relevant documents.

19. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by applicable law. The unenforceable part will be treated as removed from these Terms, and this will not affect the validity or enforceability of the remaining provisions.

20. Waiver and entire agreement

If we fail to exercise or enforce any right or provision of these Terms, this does not waive that right or provision.

These Terms, together with any policies or operating rules we post on this site or in relation to the Services, make up the entire agreement and understanding between you and us and govern your use of the Services. They replace any prior or contemporaneous agreements, communications and proposals between you and us, whether oral or written, including earlier versions of these Terms.

Any ambiguity in the interpretation of these Terms will not be construed against the party that drafted them.

21. Assignment

You may not delegate, transfer or assign this agreement, or any of your rights or obligations under these Terms, without our prior written consent. Any attempt to do so without consent is null and void.

We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.

22. Governing law

These Terms, and any separate agreements under which we provide Services to you, are governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Fayloris is headquartered.

You and Fayloris consent to venue and personal jurisdiction in those courts.

Headings are included for convenience only and do not limit or otherwise affect these Terms.

You can review the latest version of these Terms at any time on this page.

We may, at our sole discretion, update, change or replace any part of these Terms by posting updates and changes on our website. It is your responsibility to check our website regularly for changes.

We will notify you of any material changes as required by applicable law, and those changes will take effect on the date stated in the notice.

If you continue to use or access the Services after changes have been posted, you accept those changes.
